Where the 45L Energy Efficient Tax Credit Stands Now
The 45L energy-efficient tax credit rewarded homebuilders and developers for building energy-efficient residential units, worth as much as $5,000 per qualifying unit at its peak. Under the One Big Beautiful Bill Act, that credit is no longer available for any qualified new energy-efficient home acquired after June 30, 2026. The date is a hard stop tied to acquisition, not construction. A unit that was sold or leased on July 1, 2026, or later doesn’t qualify, regardless of how efficient it is or when the foundation went in.
What that means in practice is narrower than “the credit is gone.” If a buyer closed on or before June 30, 2026, that unit may still belong on your 2026 return. Still-open prior tax years matter too. Homebuilders who never claimed 45L on units acquired between 2022 and 2025 can often amend and recover it. Prince CPA Group reviews your closing records against the certification standards that apply each year and tells you what is genuinely still on the table and what is not.
What Homebuilders Should Focus On Now
Energy-efficient construction still lowers operating costs for buyers and renters, and that still helps move inventory. What changed is the tax treatment, not the market. The harder problem is for homebuilders who priced 45L into pro formas for communities delivering in 2027 and beyond. That line is gone from the model, and the gap has to be covered somewhere else.
This is the work we do anyway. Prince CPA Group builds cash flow management systems for the homebuilding industry, models the tax effect of a project before you commit capital to it, and looks at cost recovery, entity structure, and timing across your whole book rather than one credit at a time. Federal energy tax credits were one line in a homebuilder’s tax strategy. The strategy did not end when they did.

What the 45L Tax Credit Requirements Were
The 45L tax credit requirements set performance thresholds that a dwelling had to hit before it counted. For homes acquired in 2023 and later, that generally meant ENERGY STAR certification or, for the higher amount, DOE Zero Energy Ready Home certification. Multifamily projects had their own path, with prevailing wage compliance determining whether a unit earned the base amount or the full one. Every version of the program required a qualified third-party rater to certify the unit before the credit could be claimed.
Claiming the 45L Energy Efficient Builder Tax Credit on Units Already Closed
The 45L energy-efficient builder tax credit follows the acquisition date, which is the single most useful fact for any homebuilder still sorting this out. Units that a buyer purchased, or a tenant leased as a residence, before July 1, 2026, remain eligible. For a builder who closed a hundred units in the first half of 2026, that is real money still sitting on the 2026 return. The 45L tax credit multifamily provision worked the same way, and a mid-size community can carry a six-figure credit if the certifications were done correctly at the time. What the credit won’t do is reach forward. Nothing acquired in the second half of 2026 or after qualifies.
45L Tax Credit Qualifications and the Documentation Problem
Meeting the 45L tax credit qualifications on paper is only half of it. The claim lives or dies on documentation: the rater’s certification, the energy model, the closing date on each unit, and evidence of prevailing wage compliance where a multifamily project claimed the higher amount. Records get thin fast on projects that closed two or three years ago, especially when a rater has since changed systems or a superintendent has moved on. Prince CPA Group works through what you actually have, identifies which units can be substantiated, and files accordingly. We will tell you when a unit cannot be supported rather than putting a soft claim on a return.
